Terms of service for the ticket buyer

When visiting and using the Ticketsio web platform (henceforth e-ticket shop), the following terms of service (henceforth terms of service) apply to the user of the e-ticket shop (henceforth Buyer):

1.      Service and tickets

1.      The Buyers can buy tickets from the e-ticket shop, which have been added to the e-ticket shop by the organiser of the event (henceforth Organiser).

2.      Ticketsio sells tickets at the request, in the name of and at the expense of the Organiser, and does not have the right to implement or change the ticket price or the Organiser’s terms of sale, including buying back tickets or exchanging tickets, compensating for destroyed, lost, stolen or damaged tickets or any other objects related to the event. Ticketsio is not the Organiser of any of the events.

3.      To purchase tickets, the Buyer should select the class of ticket and amounts, and enter the required information, which may vary across events.

4.      The Buyer will receive the purchased e-tickets via e-mail immediately after making the payment in their internet bank, by credit card or as a transfer based on an invoice.

5.      When purchasing tickets at a reduced price, Ticketsio does not verify whether the Buyer fulfils the necessary conditions for receiving the reduced price. Purchasing a ticket at a reduced price does not guarantee entrance to the event, and whether the reduced price applies to the person entering with that ticket will be checked on location at the event venue.

2.      Ticketsio’s rights and obligations

1.      If the Buyer enters false information, Ticketsio has the right to block their purchasing rights.

2.      If these terms of service are violated, Ticketsio has the right to unilaterally cease the use of the e-ticket shop for that Buyer and/or terminate the ticket purchasing process.

3.      Ticketsio has the right to use personal data as outlined in the privacy policy.

3.      The Buyer’s rights and responsibilities

1.      The Buyer has the right to purchase tickets through the e-ticket shop according to the terms of service. In case of violations of these terms, Ticketsio has the right to limit that right.

2.      By carrying out any transactions on the e-ticket shop website, the Buyer confirms that:

1.      he or she is at least 18 years old, a natural person with active legal capacity (natural persons of limited legal capacity aged 7-18 confirm respectively that they have the consent of their legal guardian for using the e-ticket shop, who has provided them with the means to purchase the ticket) or that they are a legal person, whose representative has all rights to use the e-ticket shop on behalf of the legal person and to take on obligations on behalf of that legal person;

2.      he or she fulfils all the terms of service of the e-ticket shop;

3.      he or she has disclosed only correct information;

4.      he or she ensures the confidentiality of their user name and password.

4.      Intellectual property rights

1.      All the text, graphics, edited content, all information, all layouts, all drawings, images, HTML, appearance and feel, photos, music, sounds, images, software, videos, design, font and other content (henceforth: material protected by rights) that the users see or read when using the platform (except for the content created by the users that Ticketsio has the right to use) is the property of Ticketsio or the Organiser of the event. Material protected by rights is protected in all forms, on all information carriers, and in all existing and future technological solutions. Material protected by rights is protected under local and international copyright and patent laws, as well as other rights and laws pertaining to assets. Users cannot copy, download, use, redesign, reformat or reproduce any of the materials from the platform without the prior written expressed consent from the owner. Using material protected by rights (except if authorised in the terms of service) without Ticketsio’s permission and/or (if applicable) without the authorisation of the owner of the content created by the user is prohibited.

2.      Ticketsio service marks and trademarks (including the name Ticketsio and Ticketsio logos) are service marks that belong to Ticketsio. Other trademarks, service marks, logos and/or trade names that are disclosed through the platform belong to their owners. You cannot copy or use these trademarks, logos or trade names without the written expressed consent of their owners.

5.      Personal data

1.      Questions pertaining to the processing of personal data have been regulated by the privacy policies of Ticketsio and the Organiser, as well as the applicable legal acts.

6.      Liability

1.      All rights and obligations related to the tickets are enforced by and notified of by the Organiser and Ticketsio is not liable for the content, change or fulfilment of these rights and obligations.

2.      Ticketsio is not a representative of the responsible party for the Organiser’s or artist’s event taking place, its contents, information, advertisement and quality. The responsible party is the Organiser.

3.      Ticketsio is not liable for a delay in the delivery of the ticket, which has been caused by the user of the e-ticket shop entering incorrect information, by the actions of third parties, by interruptions to the internet connection between the e-ticket shop and the client, as well as by any other circumstance beyond Ticketsio’s control.

4.      If the event does not take place, if it is postponed or if its location is changed, Ticketsio is not obligated to buy back or compensate the tickets. The Organiser is responsible for either buying back or compensating the tickets.

7.      Final provisions

1.      Ticketsio reserves the right to change its terms of service by publishing a new redaction on the Ticketsio website.

2.      The usage of the e-ticket shop is subject to the laws of the Republic of Ireland.

3.      Disputes arising from using the e-ticket website will be resolved in Dublin according to these terms of service and the laws of the Republic of Ireland. The Buyer, who is a consumer, also has the right to turn to the Consumer Disputes Committee.

 

Terms of service for the event organiser


1.      Parties to the contract and the object of the contract

1.      Ticketsio Ticketing (RaystudiosLTD), address 26 Maple Road Carrigtowhil Co Cork Ireland e-mail info@Ticketsio.com, provides a legal person (henceforth Organiser) that has registered as a user on the Ticketsio.com website the service of ticket mediation, by web-based mediation of electronic tickets to the consumer (henceforth Buyer).

2.      Ticketsio provides the Organiser a web-based service, through which the Organiser can sell the end-user tickets (henceforth service). Ticketsio provides the Organiser the service through the Ticketsio web-based information system (henceforth ticket shop) at the website address Ticketsio.com.

3.      Service description. The service entails the development, updating, maintenance, and hosting of the e-ticket shop, e-ticket sale mediation, e-ticket delivery via e-mail in an electronic format, payment solutions, reporting and user support by Ticketsio for the Organisers.

4.      Ticket checking service. The service does not include ticket checks by Ticketsio at the Organiser’s event. Ticket checks should be organised by the Organiser independently on the territory of the event, and the Organiser is responsible for obtaining the necessary internet connection and hardware solutions.

2.      Service fee payment to Ticketsio

1.      The payment to Ticketsio by the Organiser for the service is calculated based on the ticket sales volume through Ticketsio, according to public pricelist available at Ticketsio.com/pricing.

2.      All proceeds from the sales of the tickets will first be transferred to the account of the payment service provider. The payment service provider will transfer the proceeds to Ticketsio, after taking out the payment service fee. Ticketsio will transfer the proceeds in turn to the Organiser at the beginning of each i, on the fifth working day of the month at the latest, for the previous month, unless otherwise agreed by the Organiser and Ticketsio. When transferring the ticket sale proceeds to the Organiser, Ticketsio will deduct their service fee. Ticketsio will submit an invoice to the Organiser detailing the withheld fee.

3.      The Organiser promises to use Ticketsio signage or description in all printed materials related to the event or in any other advertisements related to ticket sales.

4.      Information and explanations about using Ticketsio signage or descriptions are available on the Ticketsio website.

3.      Obligations of the Organiser

1.      Upon entering into this contract, the Organiser confirms that they will submit correct information about the Organiser’s data to Ticketsio, will give clients all the necessary and correct information about the event and tickets on the Ticketsio platform, will accept tickets sold via the Ticketsio platform, will pay Ticketsio a fee for the services rendered, and will refrain from damaging any of Ticketsio’s rights and interests, including intellectual property rights.

2.      When registering as a user on the Ticketsio platform, the Organiser is obligated to submit to Ticketsio correct information about their person and contact information. The Organiser will among others submit the following information: Business name of the company, registration code, mailing address, VAT number, bank account number, for Ticketsio to forward the ticket sales proceeds.

3.      When entering events independently into the Ticketsio platform and managing them, the Organiser is obligated to present clients with all the necessary and correct sales information, including information about the ticket price, the time and location of the event, the description of the event, and information related to processing personal data. The Organiser should comply with personal data protection regulations, as the data controller of personal data submitted during ticket sales, and is responsible for the purposeful use of the data and for the existence of the legal basis for collecting and processing the data. The Organiser is responsible for the legality of processing personal data.

4.      In relation to the personal data involved in providing the service, the Organiser gives Ticketsio permission to process all data collected by the Organiser or data that is necessary for the provision of the mediation service, to the extent and for the purposes described in these terms of service.

5.      The Organiser is obligated to accept tickets sold through the Ticketsio platform to clients.

6.      The Organiser agrees that the fee payable to Ticketsio will be deducted from the sales proceeds to be forwarded to the Organiser.

7.      The Organiser is obligated to present the Buyers with their terms of sale related to the ticket purchase.

8.      If the Organisers foresee that despite the provisions of § 53 (4) (72) of the Law of Obligations Act the Buyers have the right to withdraw from the contract, the Organiser is still obligated to pay Ticketsio the fee for mediating the ticket as per these terms of service.

4.      Obligations of Ticketsio

1.      Ticketsio provides the Organiser with the opportunity to organise ticket sales through the Ticketsio platform, ensures that the information about the Organier’s ticket sales is accessible on the Ticketsio platform, transfers to the Organiser the proceeds from last month’s ticket sales by the fifth working day of the month at the latest, from which the payment service provider and Ticketsio have previously deducted their service fees. Additionally, Ticketsio provides the Organiser with the opportunity to use Ticketsio software to check tickets sold through Ticketsio at the entrance of the event.

2.      By organising ticket sales through the Ticketsio platform, Ticketsio allows:

1.      The Organiser to sell tickets at the price and in the amount desired by the Organiser for venues without numbered seating;

2.      The Organiser to sell different classes of tickets for one event;

3.      To determine what kind of information the Organiser needs from the Buyers;

4.      The Organiser to determine the beginning time and ending time of the sale for the whole event as well as for different classes of tickets;

5.      The Organiser to display event information in different languages;

6.      The Organiser to monitor in real-time the amounts of bought and checked tickets.

7.      User support. Ticketsio offers the Organiser user support via e-mail and phone during working days from 10 am to 5 pm. The user support contacts are info@Ticketsio.com. The primary user support for ticket Buyers is organised by the Organiser and ticket Buyers are first directed to the Organiser’s general information phone number and contacts. If the Organiser cannot independently answer the ticket Buyers’ questions or resolve problems, they will forward the question or concern to Ticketsio.

3.      Information about ticket sales is available for the Organiser upon logging into the Ticketsio platform at any moment, except at previously notified maintenance times for the Ticketsio platform or due to interruptions to using the platform for reasons beyond Ticketsio’s control.

4.      Ticketsio enables the Organisers to use software that can be used by the Organiser to check the validity of tickets bought through the Ticketsio platform, to validate a valid ticket and register it as used with a device that has an internet connection.

5.      Liability

1.      Ticketsio mediates tickets in the interest of the Organiser and is not liable for the terms of sale or any claims arising based on the sales contract. The Organiser is liable for any claims.

2.      Ticketsio mediates tickets at the request, in the name of and at the expense of the Organiser, and does not have the right to implement or change the ticket price or the Organiser’s terms of sale, including buying back tickets or exchanging tickets, compensating for destroyed, lost, stolen or damaged tickets or any other objects related to the event. When purchasing the ticket, the sales contract is entered into by the Organiser and the Buyer.

3.      All rights and obligations related to the tickets are implemented and notified of by the Organiser, and Ticketsio is not liable for the rights and obligations of those contents, for their changes or for their fulfilment. The Organiser is obligated to notify the Buyer also of all aspects related to personal data issues.

4.      Ticketsio is not a representative of Organiser or artist and is not responsible for the event taking place, its contents, information, advertisement or quality. The responsible party is the Organiser.

5.      If the event does not take place, if it is postponed or if its location is changed, Ticketsio is not obligated to buy back or compensate the tickets. The Organiser is responsible for either buying back or compensating the tickets.

6.      Neither the Organiser nor Ticketsio are responsible for any breaches to the contract caused by force majeure, including, for example, widespread power outages or internet outages. If the force majeure passes, the Organiser and Ticketsio must continue fulfilling their obligations as soon as is possible after the force majeure conditions cease.

7.      Service provision may be interrupted due to Ticketsio’s service providers (for example, the payment service or server maintenance). In such a case, Ticketsio is not considered to be in breach of contract, and Ticketsio will restore the service provision at the first opportunity.

6.      Personal data

1.      In clause 3.4 of these terms of service, the Organiser has given Ticketsio the authorisation to process the Buyer’s data to the necessary extent described in these terms of service. Ticketsio processes personal data according to the Organiser’s instructions.

2.      Personal data, for which the Organiser has given Ticketsio authorisation as per clause 3.4 of these terms of service, include: e-mail address, phone number, class of ticket purchased, purchase IP and information about cookies, language of purchase, marketing channel used to reach the purchase, the browser and operation system used, the name of the Buyer, the payment method, the name of the bank used for payment, payment status, time that the ticket was used and any additional data the Organiser has requested from the Buyer

3.      Ticketsio processes personal data as long as it is necessary for providing the service and for being in compliance with regulations set out in law (for example, for accounting purposes).

4.      Ticketsio has the right to refuse processing data in a situation, where the Organiser is not able to confirm to Ticketsio that the personal data processing is legal.

5.      Ticketsio confirms that the confidentiality obligation extends to Ticketsio employees and service providers, who process the personal data listed above.

6.      Ticketsio confirms that they use the appropriate technical and organisational means for the protection of data.

7.      Ticketsio involves new data processors in the work only with the prior written consent of the Organiser.

8.      In case the Organiser has to respond to or act due to a claim filed by a data subject, Ticketsio will assist the Organiser according to their capabilities.

9.      According to their capabilities, Ticketsio will help the Organiser ensure compliance with the General Data Protection Regulation (EU 2016/679) Articles 32 to 36.

10.    Ticketsio will erase or return all personal data related to service provision if it is not in breach of the legal obligation to retain information.

11.    If needed, Ticketsio will provide the Organiser with the necessary information, in addition to what has been provided in these terms of service, so that the Organiser could fulfil their obligation, as outlined in the General Data Protection Regulation (EU 2016/679) Article 32.
